On April 18, 2013, the Federal Energy Regulatory Commission ("FERC") issued a Notice of Proposed Rulemaking proposing to adopt modifications to four existing Reliability Standards as submitted by the North American Electric Reliability Corporation ("NERC"). FERC proposes to approve revised Reliability Standards FAC-001-1 (Facility Connection Requirements), FAC-003-3 (Transmission Vegetation Management), PRC-004-2.1a (Analysis and Mitigation of Transmission and Generation Protection System Misoperation), and PRC-005-1.1b (Transmission and Generation Protection System Maintenance and Testing). Significantly, FERC proposes to apply these NERC rules to generator-owned and/or operated transmission facilities that connect the generating facilities to the transmission grid (i.e., generator tie-lines), and to a generator's protection system at the interconnection between the generator's facilities and the bulk electric system grid. Comments on the NOPR are due to be filed at FERC in approximately mid-June.
