The Commission has published a revised explanatory note to an authorization to conduct an inspection in execution of a Commission decision under Article 20(4) of Council Regulation No 1/2003. The note in general provides guidelines regarding e.g. the dawn raid procedure and documentation, the powers of the investigators and the undertaking’s rights during the dawn raid. The revised note provides additionally, in particular, detailed guidance on the inspectors’ powers to conduct searches on the company’s computers and other electronic records, e.g. by obligating the company to make its staff available to assist the investigators in specific tasks as well as providing for a list of possible storage media and broader search tools that can be used. The Commission also remarks that the revised explanatory note is published for information only and is without prejudice to any formal interpretation of the investigation powers of the Commission.
