The Flexible Working (Eligibility, Complaints and Remedies) (Amendment) Regulations 2009 came into force on 6 April 2009. These Regulations permit parents with children under 17 to request flexible working. This right was previously restricted to the parents of children under 6 (unless disabled). Employers are still entitled to refuse any such request on the grounds set out in the Employment Rights Act 1996 (the Act). This change means that only those parents of children aged 17 do not have the right to request flexible working under the Act (unless the child is disabled).The right to request flexible working was previously extended to the carers of adults in need of care in April 2007.
