U.S. EPA has “a new way of doing business” at Supefund sites. On September 30, 2009, EPA’s Office of Site Remediation Enforcement issued interim guidance that seeks to shorten the time between the issuance of a Record of Decision for a site and implementation of a remedy. Among other things, the guidance shortens the timeframes for negotiation with potentially responsible parties, facilitates more frequent and systematic dialogue among the Department of Justice, EPA Headquarters, and Regional staff, and encourages earlier use of unilateral administrative orders for all or part of the work when negotiations bog down. The guidance does not, however, alter or extend the enforcement moratorium provided by Section 122(e)(2) of CERCLA. EPA will evaluate the effectiveness of the implementation of the interim guidance in eighteen months.
