Of significance to employers, the bill, which was signed into law last Wednesday, eliminates the common-law cause of action for wrongful discharge based on “EEO” discrimination. I talked about that here.
Here is a copy of the lawsuit, filed today in federal court in Greensboro, North Carolina. The plaintiffs are three individuals (two transgender men and a lesbian), the American Civil Liberties Union, and Equality NC, an LGBT advocacy group. The suit alleges that the legislation is unconstitutional on equal protection and privacy grounds. It also contends that the legislation would force the University of North Carolina system to violate the sex discrimination prohibitions in Title IX.
The plaintiffs are asking the court to declare that the law is unconstitutional and illegal, to enjoin (block) enforcement of the law, and other miscellaneous relief, including attorneys’ fees.
