The Secretariat of Foreign Trade (“SECEX”) has initiated a sunset review regarding antidumping duties applied on imports of table fans from China that are over 15 centimeters, with a self-contained electric motor and an output not exceeding 125W (Mercosur Common Nomenclature - NCM 8414.51.10), according to the SECEX Circular No. 28/2018, published July 17, 2018, in the Brazilian Official Gazette (“D.O.U.”).
The antidumping duty on table fans has been in force in Brazil since 1995, with three revision processes having followed the first imposition of duties. This fourth review was requested by SEB do Brasil Produtos Domésticos Ltda., SEB Comercial de Produtos Domésticos Ltda., Britânia Eletrodomésticos S.A. and MK Eletrodomésticos Mondial S.A.
Any interested third party may request participation in the process within 20 days of the publication in the D.O.U. In addition, exporters, importers and domestic producers already identified by the authority will receive a questionnaire which must be answered within 30 days. It is presumed that domestic interested parties will be notified within 5 (five) days, and international parties within 10 (ten) days, after the mailing of the documents by the Department of Commercial Defense (“DECOM”).
The antidumping duty on table fans, defined by the Chamber of Foreign Trade (“CAMEX”) Resolution No. 52/2013 will be in force until the end of the sunset review, which should occur within 10 months, extendible for a further 2 months.
