The Data Protection Commissioner of Niedersachsen has criticised the ongoing pilot project on the use of so-called “bodycams” by the police of Niedersachsen. The Commissioner pointed out that currently, there is no legal basis for such a practice, noting that compared to other forms of video surveillance, the use of bodycams constitutes a particularly serious encroachment upon basic rights. In addition, the Commissioner criticised the Ministry of the Interior of Niedersachsen for failing to conduct checks, which are legally required, prior to introducing the bodycams (Vorabkontrolle). However, the Commissioner also made it clear that she is not against the police using bodycams in principle, but she argued that such a practice should not be introduced until the state parliament has adopted an explicit legal basis for it.
