Yet another post on LCN!
This is one of the most discussed topics in the media sector these days given the economic impact of the LCN regulations on media services operators.
See here our previous post. At that time, some might have thought that the Commissioner’s draft plan was to be the end of the story.
However, the Consiglio di Stato (Supreme Administrative Court) just added a new chapter to the saga. On November 26, 2014 the Consiglio di Stato issued an interim decision stating that the Commissioner’s draft plan was not in line with the guidelines given to the Commissioner by the same Consiglio di Stato with its prior decision (see here).
The Commissioner will have to start from scratch for the third time. In particular, the Consiglio di Stato requested the Commissioner to: (i) acquire from the AGCOM and the Ministry for the Economic Development certain documentation necessary to assess how many ex-analogue generalist channels weer operating at the time the first LCN plan had been adopted, and (ii) issue a new draft plan by December 13, 2014.
