On September 25, 2015, the Constitutional Court of the Judicial Yaun delivered Interpretation No. 732.  In the ruling, the Court held as unconstitutional the relevant provisions under the Mass Rapid Transit Act (promulgated and amended in 1988 and 2001respectively) and the “Rules for Joint Development of Land in the Mass Rapid Transit System” (promulgated and effective in 1990).  These provisions authorized the competent authorities to expropriate land adjacent to the MRT system for the purpose of land development, and are deemed unconstitutional because they were not necessary for the use of the MRT system and they violate people’s property rights and right to choice of residence protected by the Constitution.  Such unconstitutional provisions shall be inapplicable from the publish date of this Interpretation.
