The MOEAIC has loosened restrictions on investing in domestic enterprises by foreign nationals.  Major amendments include: (1) foreign investors may invest in domestic enterprises by contributing monetary claims for shares; (2) in relation to the qualification of foreign investors who may invest in domestic enterprises by means of a share exchange, the following conditions are required to be met: (A) the foreign investor has actual operating activities,  (B) it has been listed on securities markets outside of Mainland China, and (C) it is in the same corporate group as the domestic enterprise.
