Under new regulations the HSE will have a scheme in place from 1 October 2012 under which businesses will have to pay for the HSE’s time when they are found to be in breach of health and safety law. The hourly rate is set at £124. Businesses will continue to accrue the fees until it has corrected the issues to the HSE’s satisfaction so the full cost to the business will not be known until the investigation is over. All businesses inspected by the HSE will be affected by this introduction. The revised guidelines give the HSE power to decide when there has been a contravention but it is up to each individual inspector to determine the level of investigation they feel is sufficient to identify and remedy a breach.
