Law for Coordinated Energy Regulatory Agencies
On August 11, 2014, it was published in the Federal Official Gazette the Decree whereby the new Law for Coordinated Energy Regulatory Agencies (the “Regulators Law”) is issued. Consequently, such amendments will be in force as of August 12, 2014.
The Regulators Law is regulatory of the Constitution, which upon being amended in December 2013, states that the regulatory agencies on energy matters will be (i) the National Hydrocarbons Commission (“CNH”) and (ii) the Energy Regulatory Commission (“CRE”).
Consistent with the rise of a new energy industry that will involve the participation of new companies along with PEMEX and the Federal Electricity Commission, the Regulators Law grants CNH and CRE their own legal standing, as well as technical, procedural and budgetary autonomy.
Each of these regulatory agencies will have (i) a Governance Organism, comprised of seven commissioners and (ii) an Executive Secretariat.
Among the more important attributions of CNH are the following:
- Regulate and supervise surface property surveys and exploration, as well as the exploration and exploitation of hydrocarbons, including their collection from production points up to their integration into transportation and storage systems;
- Issue tenders and subscribe hydrocarbon exploration and exploitation agreements;
- Technically manage hydrocarbon exploration and exploitation assignations and agreements and
- Provide technical advice to SENER.
On its part, CRE will regulate and provide for the efficient development of the following activities:
- The transportation, storage, distribution, compression,
liquefaction and regasification, as well as the supply of oil, natural gas, liquefied gas oil products and petrochemicals to the public;
- Transportation through pipelines, storage, distribution and supply of biofuels to the public;
- Power generation, public services of power transmission and distribution, power distribution not forming part of a public service and the wholesale marketing of electricity.
