In a judgement issued on February 25, 2016, the IP Court sustained the TIPO’s decision that had rejected an application for registration of the word mark “360do BRUSH” for the goods category “toothbrushes” in Class 21.  The IP Court indicated that the word “do” contained in the contested mark “360do BRUSH” is identical in pronunciation to the Chinese word “度”.  The general consumer may be under the impression that the term “360do BRUSH” seeks to describe the applicant’s “toothbrush” product as having a function of 360 degrees rotation or a design of a round brush head.  Therefore, the term “360do BRUSH” is descriptive of the function, effect or other features of the product and lacks inherent distinctiveness.
