On 17 May 2012, the OFT accepted voluntary assurances from Clear Channel UK and JCDecaux and closed its investigation into whether street furniture advertising contracts between these companies and individual local authorities breach the Competition Act 1998. Clear Channel and JCDecaux have voluntarily agreed not to enforce certain exclusivity clauses, “first refusal” clauses or tacit renewal clauses in their contracts with local authorities. In addition they will not pro-actively seek extensions to contracts, will clarify the end dates of their contracts and clarify the ownership of street furniture at contract termination. On the basis of these assurances, the OFT has, on grounds of administrative priority, closed its investigation, without making an decision as to infringement.
