The South Australian Industrial Court has handed down its judgment in Perry v Carter [2014] SAIRC 2 (22 January 2014), fining Mr Carter (Director of United Cranes and Rigging, and Site Supervisor and Manager for United Precast Pty Ltd) $1,750 (after a 30% discount for pleading guilty) and ordering him to attend a construction safety course.  The conviction relates to a 2011 incident where two employees were at risk of being injured when a concrete pre-cast panel, which was being installed under Carter’s supervision, fell.  Carter failed to take reasonable care to avoid adversely affecting the health or safety of workers by failing to ensure the panel was appropriately supported in accordance with the approved code of practice and the shop drawings.
