In the FTC’s decision on December 12, 2013, the FTC found that the president of the Taiwan Diesel System Repair Association (“Association”) violated Subparagraph 4 of article 19 of the Fair Trade Act, enjoined him from continuing with the violation, and fined him NT$200,000. The president had made a repair service price list based on the repair market rates at the time, the prices from suppliers and his personal experience. The price list was distributed to members of the Association and, after investigation the FTC determined that some members used the price list as a basis for price negotiations. The FTC therefore found that the price list affected the prices provided in the diesel engine repair industry, inducing other competitors or potential entrants to not compete on price, resulting in a substantive reduction of price competition in the diesel engine repair services market.
