Following the changes to the TUPE regulations which came into force on 31 January 2014, a further amendment to TUPE came into force  on 31 July 2014, which is aimed at micro businesses only. The amendment provides that employers  with fewer than 10 employees may directly consult affected employees  in cases where there are no  existing appropriate representatives and the employer has not invited any affected employees to  elect employee representatives. The change affects TUPE transfers that take place on or after 31 July.
