Terrorism and the Financing of the Proliferation of Weapons of Mass Destruction

Recently, the National Assembly approved the Law No. 977 on Anti-Money Laundering, Financing Terrorism and Financing the Proliferation of Weapons of Mass Destruction (ML / TF / FP), published in the Official Gazette No. 138 on July 20th, 2018.

The Law No. 977 aims to establish mechanisms based on a risk approach to promote and strengthen the prevention, investigation, prosecution and sanction of ML / FT / FP, strengthen national legislation in accordance with the scope of the International Conventions and the main international standards on the fight against ML / TF / FP.

This Law reforms the articles of Law No. 641, Criminal Code of the Republic of Nicaragua, modifying, among others, the crime of Terrorism which will now include any person who: causes death or serious bodily injury to persons who do not participate directly in hostilities in a situation of armed conflict or that destroys or damages public or private property, when the purpose of such acts, by their nature or context, is to intimidate a population, disrupt the constitutional order or force a government or an international organization to perform an act or refrain from doing so.

Finally, several laws are partially reformed, including the Notarial Law of 1905, the Commerce Code of 1914, Law No. 561 of the General Law of Banks and Other Financial Institutions, Law No. 734 of General Bonded Warehouses Law, Law No. 733 General Law on Insurance, Reinsurance and Finance, Law No. 698 General Law on Public Registries, among others.
