On 21 October 2011, the CAT ruled on 12 applications for costs from construction companies which had appealed the OFT’s decision in the construction cartel case. In relation to an appeal made by Quarmby, the CAT considered that there had been no real winner therefore it declined to make an order for costs. In relation to the 11 other applications for costs which related to appeals solely on the level of penalties, the CAT granted the successful parties their costs up to a maximum cap of £200,000.
