Relevant aspects
The following procedures are under public
discussion: (i) revision of the National Program
for the Land Planning Policy, (ii) Portuguese
Maritime Spatial Plan and (iii) Report on the
State of Regional Planning of the Lisbon and
Tagus Valley Region.
Undergoing public discussions:
> National Program for the Land Planning
Policy: up until June 1S'h, 2018.
> Portuguese Maritime Spatial Plan: up until
June 30'h, 2018.
The public discussion periods play an important role
as they allow any interested party (public or private)
to present its comments and suggestions to the
relevant authorities, influencing the administrative
decision making process.
> Report on the State of Regional Planning of
the Lisbon and Tagus Valley Region: up until
June 18'h, 2018.
> Any interested party may submit its
comments, reclamations, suggestions or
requests for clarification.
The participation in public discussions is a relevant
opportunity to defend legal rights and protected
interests and can be a useful tool for the strategic
plan of the affected entities.
> The participation in any of the above
mentioned processes may be exercised
through the web portal Participa
(www.participa.pt).
> Upon the closure date of the public
discussion, the relevant authorities are legally
bound to consider all comments in the final
decision and provide reasoned response to
the contributors claiming the violation of
private rights or the breach of legal or
administrative rules.

National Program for the Land Planning Policy ("PNPOT")
The PNPOT sets forth the strategic options for the organization of the national land, provides the
reference framework for the other land programs and plans and constitutes a cooperation instrument
with the other Member States for the organization of the European Union space (article 30 of the Legal
Framework for the Land Planning Instruments, "RJIGT", approved by Decree-Law no. 80/2015
of May 14'h).
The effectiveness of the PNPOT over the remainder land programs and plans of lower level,
notably Municipal Master Plans, requires a particular attention to the strategic orientation set
out in the proposal subject to public discussion for two reasons:
>
The PNPOT points to a tendency of the national land management practices and
policies (mainland and islands), allowing to anticipate the public policies of the
Government and local authorities in a medium (2030) to long (2050) term horizon
and, to that extent, to anticipate strategies and business models.
> The discrepancy of the strategic direction of PNPOT with some established
position (legally protected) of an interested party may substantiate a claim or a
request for clarification to be presented in the public discussion. In such case, the
relevant authority (i.e. the Government) may serve reasoned response to the
affected party.
The public discussion period of the PNPOT revision runs from April 30'h,2018, to June 15'\
2018. All relevant documentation is available at www.participa.pt (Notice no. 4323-C/2018, of
March 28'h, as amended by Declaration no. 308-A/2018, of April 23'd).
The Portuguese Maritime Spatial Plan
The Portuguese Maritime Spatial Plan ("PSOEM") covers all the Portuguese maritime space, also
including the exclusive economic zone and the continental shelf, and represents the existing
and potential uses and activities (cf. article 9, paragraphs 1 and 2, of the Legal Framework for
the Maritime Space Planning and Management, approved by Decree-Law no. 38/2015, of March
12'h).
In this context, participating in the public discussion of the PSOEM project may be especially
relevant for operators who develop or intend to develop some kind of activity in the national
maritime space (eg. aquaculture, installation of cables and submarine pipelines, exploitation of
marine mineral resources, etc.), notably with a view to:
> Ensure that the rights granted to them by title of use of maritime space are fully
identified and guaranteed in the PSOEM.

> Ensure that the PSOEM allows and/ or enhances the development of a specific
activity at a particular place in the maritime space.
The public discussion period of the PSOEM project runs from April 30'h, 2018, to June 30'h,
2018. All relevant documentation is available at www.participa.pt (Notice no. 6013/2018, of
May B"). The project under discussion does not include the zone of the national maritime space
adjacent to Madeira and Azores.
Report on the State of Regional Planning of the Lisbon and
Tagus Valley Region
The land status reports "reflect the assessment of the implementation of the land programs and plans
under evaluation, as well as the levels of internal and external coordination achieved, substantiating a
possible need for revision" (article 189, paragraph 4 of the RJIGT) and their preparation is required
for the revision of the corresponding land programs and plans (cf. article 189, paragraph 6, of
the RJIGT).
The participation in the public discussion of the Report on the State of Regional Planning of the
Lisbon and Tagus Valley Region ("REOT") is an interesting opportunity to convey to the relevant
authorities any important elements/information that may influence the future revision
processes of the Regional Plans.
The public discussion period of the REOT project runs from May T", 2018 to June lS'h, 2018. All
relevant documentation is available at www.participa.pt (Notice no. 4860/2018, of April 12'h).
