A California appeals court has ruled that the City of Santa Cruz improperly certified the extension of water and sewer services to support an expansion of the University of California Santa Cruz campus. Habitat & Watershed Caretakers v. Santa Cruz, No. H037545 (Cal. Ct. App. 2/19/13). The court found that the environmental impact report (EIR) on which the city relied in approving the project improperly failed to consider “any feasible alternative” to the proposed project and was therefore contrary to California law. Because the EIR did not analyze limited water alternatives or other possible means to support the project without creating potential water supply problems during dry years, it could not stand, said the court. The court directed that the city prepare a new EIR and revisit its certification decision.
