The Health Act 2009 (Commencement No.1) Order 2010, made on 7 January 2010 brought into force, from 19 January 2010, various provisions of the Health Act 2009 including sections dealing with:
- the NHS Constitution;
- direct payments for health care (initially only to be available in pilot schemes under regulations);
- de-authorisation of NHS foundation trusts for the purposes of Monitor consulting and publishing guidance only;
- amendments to enactments to allow for new powers of suspension in relation to chairs, vice-chairs and other members of NHS bodies and other bodies concerned with health; and
- increasing the percentage of mental health foundation trusts' total income in each year that may be derived from private charges to 1.5 per cent.
The order also provides that sections allowing for the appointment of trust special administrators for NHS trusts, NHS foundation trusts and primary care trusts will come into force on 15 February.
1 April 2010 is the appointed day for the coming into force of sections requiring the publication of annual quality accounts in so far as they are not already in force.
