twenty-one year old worker fell through a roof of a shopping centre in Bangor, Wales, whilst employed by a roofi ng contractor, working for principal contractor Watkin Jones & Son Ltd. He sustained serious head injuries, and despite making a gradual recovery, later contracted acute meningitis and died seven months after the incident. Evidence presented in court suggested that there was more than an 80% chance that the injuries sustained in this incident contributed to his death.
The HSE prosecuted the principal contractor, Watkin Jones & Son Ltd, under section 3(1) of the Health and Safety at Work etc Act 1974. Mold Crown Court was told that the edge protection around the roof opening had been removed and that no alternative protective measures had been put in place.
The company was fi ned £450,000 and ordered to pay £98,000 in costs.
