The Antitrust Authority (AGCM), pursuant to art. 27, par. 3 of the Italian Consumer Code, has ordered the closure of two websites based in China, which by cloning the appearance of the original websites, offered counterfeit products branded Gucci and Prada at very low prices.

The owners of domain names and, Mr. Weixioung Yu and Mr. Shen Xiu, offered visitors the possibility of acquiring allegedly original products while giving a perception that websites were managed by official resellers of the infringed trademarks.

The AGCM has established that both websites have omitted:

  • any information related to the identification of origin;
  • any information on the post-sale consumer rights;
  • granting any warranty regarding the legitimacy of the products.

The two procedures, which pave the way for a new kind of protection against the external attack of “Made in Italy” products, have ordered the blockade (in the period of two days since the communication of such  measures) of any means that can give access from the Italian territory to the infringing websites. On the other hand, in the event of failure to comply, both procedures have ordered the additional intervention of the special unit of Guardia di Finanza (police for economic crimes).
