In a recent case (Simon Carves Limited v Ensus UK Limited), the court held that an interim injunction restraining a call on a bond would be granted because of the terms of the contract in respect of which the bond was provided. The terms of the contract included a clause as follows “Upon the issue of the Acceptance Certificate the Performance Bond shall become null and void (save in respect of any pending or previously notified claims)”. The Acceptance Certificate had been issued. So remember, not only check the wording of the bond but also check what the contract says about the bond.
