The New York Department of Environmental Conservation (DEC ) has submitted a request to the New York Department of State for a 90-day extension to finalize hydraulic fracturing regulations. The final regulations were due November 29, 2012, and the request for extension is evidently intended to give the state health commissioner time to review health impacts of fracturing in natural gas drilling. According to DEC , to receive the extension, DEC was required by law to re-file the draft regulations together with its analysis of comments received on a draft rule published earlier this year. The DEC states that it will accept comments on the revised regulations until January 11, 2013, but it “will not take any final action or make any decision regarding hydraulic fracturing until after [the health commissioner’s] health review is completed and DEC , through the environmental impact statement, is satisfied that this activity can be done safely in New York State.”
