The Finnish Supreme Administrative Court has recently considered (KHO:2013:168) that an international trademark SKAN PACK (figure) was confusingly similar to a national registered business name SCANPACK OY and therefore the former could not be registered in Finland in its entirety.
The trademark concerned postal packaging in class 16. The registered field of business of SCANPACK OY was foodstuff packaging, yet it had not been limited and could concern also postal packaging in class 16. The Court concluded that foodstuff packaging does not necessarily mean only packaging wherein the foodstuff is delivered to a consumer. The trademark was also phonetically identical to the business name. These issues created a risk of confusion, which constituted an obstacle for the registration.
