The National Mining Association (NMA) has filed a motion for a preliminary injunction in federal court seeking to block the implementation and enforcement of EPA guidance issued April 1, 2010, that imposed strict permit requirements on coal operators involving mountaintop removal and the deposit of waste rock in stream valleys in the Appalachian Mountains. NMA v. Jackson, No. 10-1220 (D.D.C. filed 9/17/10). The motion argues that the guidance and related federal actions targeting CWA permits for Appalachian surface mines violate the APA, CWA and NEPA. NMA also challenges the “enhanced coordination process” for regulatory oversight of surface coal mining set out in a June 11, 2009, memorandum of understanding issued jointly by EPA, the U.S. Army Corps of Engineers and the Department of Interior’s Office of Surface Mining Reclamation & Enforcement.
