New Jersey is operating at a deficit, so the DEP is looking to collect every dollar possible to cover its budget. Do not be surprised if the DEP attempts to raise fees for permits or regulatory approvals in the near future. Indeed, in a recent money-raising initiative, some facilities that were subject to remediation oversight fees but had not been invoiced for years, suddenly received invoices “out of the blue.” Many of these invoices, which often included costs that were positively ancient, are either in dispute or are being negotiated. The DEP’s Oversight Regulations only provide a procedure for contesting the calculation of oversight costs. There is no formal procedure to contest the substantive basis of the actual oversight costs.
