A parliamentary inquiry into bullying at WorkCover NSW has revealed that additional State-based anti-bullying legislation is required to fill a gap in the existing anti-bullying legislative framework, to ensure that all workers in State government departments and agencies are protected from workplace bullying.

The inquiry found that the Workplace Health & Safety Act, which operates in various States, fails to deal adequately with bullying in the workplace.  This is an issue for State and local government workers who are not covered by the Federal anti-bullying legislation.  It affects State government authorities like WorkSafe, where the issue of bullying “is a longstanding one and operates at a cultural level".
