On 10 August 2011, the Office of Fair Trading (“OFT”) announced that it has issued its final decision in its retail dairy products investigation. It has found that four supermarkets (Asda, Safeway, Sainsbury’s and Tesco) and five dairy processors (Arla, Dairy Crest, Lactalis McLelland, The Cheese Company and Wiseman) breached the Competition Law by co-ordinating price increases for certain dairy products through indirect exchange of retail price pricing intentions in 2002 and/or 2003. The OFT has imposed total fines of £49.51 million. Arla received complete immunity from fines under the OFT’s leniency programme. All the other companies, except Tesco, received reductions of 30-35% for agreeing to early resolution. Read more
