On November 17, 2014, the U.S. International Trade Commission ("Commission") issued a press release announcing their vote to institute an investigation of Certain Windshield Wipers and Components Thereof (Inv. No. 337-TA-937). Please note that Oblon Spivak represents Complainants in this matter.
The investigation is based on an October 15, 2014 complaint and an October 29, 2014 letter supplementing the complaint filed by Valeo North America, Inc. of Troy, Michigan and Delmex de Juarez S. de R.L. de C.V. of Mexico alleging violation of Section 337 in the importation into the U.S. and sale of certain windshield wipers and components thereof that infringe one or more claims of U.S. Patent Nos. 7,891,044 and 7,937,798. According to the Notice of Investigation, the Commission has identified Trico Products Corp. of Rochester Hills, Michigan, Trico Products of Brownsville, Texas, and Trico Componentes SA de CV of Mexico as the respondents in this matter. The Notice of Investigation further indicates that ALJ Thomas B. Pender is designated as the presiding ALJ in this matter since he is presiding ALJ in Inv. No. 337-TA-928, "in view of the overlapping subject matter in the two investigations." The Notice of Investigation also indicates that ALJ Pender "is authorized to consolidate Inv. No. 337-TA-928 and this investigation if he deems it appropriate." Lastly, the Notice of Investigation explains that the Office of Unfair Import Investigations will not participate as a party in this investigation.
