The Arkansas Department of Environmental Quality (“ADEQ”) and the Springdale, Arkansas School District (“District”) entered into a December 13th Consent Administrative Order (“CAO”) addressing alleged violations of a No-Discharge Permit. See LIS No. 16-101.
The CAO states that the District operates a septic system with subsurface disposal at the Sonora Middle School (“school”) located in Springdale, Arkansas.
The school is stated to be regulated under No-Discharge Permit 5116-W (“permit”) issued to it on November 30, 2011.
The permit is stated to have expired on November 30, 2016. The permit requires that the District submit a complete application for a new permit at least 180 days prior to the expiration date of the permit if the activity regulated by the permit is to continue past the expiration date. See Part II, Condition 23 of the permit.
The District is alleged to have failed to submit a complete application for a new permit as required by Part II, Condition 23 of the permit. Therefore, the District is alleged to have violated Ark. Code Ann. § 8-4-217(a)(3).
The District’s intent is to operate the facility beyond the expiration date of the current permit (November 30, 2016).
The CAO requires that the District submit a complete application for a new permit as required by Part II, Condition 23 of the existing permit on or before November 30, 2016.
The District is required to comply with the existing permit until the new permit is effective.
