On July 17, 2009, the Federal Communications Commission (FCC) issued its Request for Further Comment and Further Notice of Proposed Rulemaking (FNPRM) responding to the D.C. Circuit's 2008 remand of certain Part 15 requirements governing Access Broadband over Power Line (Access BPL) systems, and soliciting comment on measurement guidelines for disruptive radio frequency emissions that may be generated by those systems.
As instructed by the Court, FCC now has placed in the record complete, un-redacted versions of Staff's preliminary research, educational information, and technical studies on which FCC based its final regulations, but were previously unavailable for review and public comment. The FNPRM also offers FCC's reasoned explanation for its selection of the current extrapolation factor used to measure radio frequency emissions from Access BPL systems, and requests specific comment on: (1) whether the current extrapolation factor is supported by the additional information and materials placed in the record; (2) whether the current extrapolation factor should be adjusted to reflect new technical studies by Institute of Electrical and Electronics Engineers (IEEE); and (3) whether FCC, in the alternative, should allow use of special procedures to determine site-specific extrapolation values.
Initial Comments on the FNPRM will be due on September 23, and Reply Comments will be due 15 days thereafter, on October 8.
