With effect from 1 October 2011, Part 36 is amended to give effect to adverse comments made in the Jackson Report about Carver v BAA plc and the interpretation the Court of Appeal gave to the phrases “more advantageous” and “at least as advantageous” in CPR 36.14. CPR 36.14(1A) will provide “For the purposes of paragraph (1), in relation to any money claim or money element of a claim, “more advantageous” means better in money terms by any amount, however small, and “at least as advantageous” shall be construed accordingly.”
