On 24 July 2009, the Financial Services Authority (FSA) published a policy statement (PS09/13) to confirm proposals (reported in the March and May editions of Tracker) to alter the rules regarding with-profit compensation payments. The changes will prohibit compensation and redress payments out of any part of insurers' with-profits funds due to operational failures occurring after 31 July 2009. However, the position is unchanged where the operational failures occurred prior to 31 July. The UK consumer group, 'Which?' has expressed dissatisfaction at the FSA's decision to only apply the new rules to future failures.
