Directive 2009/29/EC of 23 April 2009 amending Directive 2003/87/EC so as to improve and extend the greenhouse gas emission allowance trading scheme of the Community has been implemented in Dutch law. The relevant legislation, consisting of amendments to the Environmental Management Act (Wet milieubeheer) and the Economic Offences Act (Wet op de economische delicten), was published on 8 May 2012 and contains rules supplementing the provisions of the Directive. Some of the new rules entered into force on 1 July 2012; others will do so on 1 January 2013.

In connection with the amendments to the Environmental Management Act and the Economic Offences Act, amendments have also been made to – inter alia – the Emission Allowances (Trading) Decree (Besluit handel in emissierechten) and to the Ministerial Regulation on the Monitoring of Emission Allowances Trading (Regeling monitoring handel in emissierechten). This was done by decrees dated 16 May 2012 and 13 June 2012, respectively.
