The application was filed in Class 30 for "coffee and artificial coffee" and the Colombian Coffee Growers Federation contacted the owner in an attempt that he voluntarily withdraw the application. They claimed that Nariño is an important coffee region of Colombia and therefore, the application was incurred in absolute grounds for refusal. The applicant refused to withdrawing its application and the Federation opposed arguing that the mark was (1) descriptive if the coffee was coming from the cited region (2) misleading if not coming from the cited region and (3) contrary to law, in particular contrary to the regulation on the protection of geographical indications and designations of origin being the Nariño region under the protection of the geographical indication (PGI) "CAFE DE COLOMBIA".

The SPTO accepted the arguments of the opponent, especially on the PGI and the trademark application was rejected.
