A new law passed in Illinois which requires consent before biometric information can be captured for commercial purposes has resulted in class actions to be filed against Facebook and Shutterfly. Such cases will inevitably have ramifications for any business that employs biometric-capture technology, including those who use it for security or sale-and-marketing purposes. Talking about biometric capture activities Torsten M Kracht and Rachel E. Mossman, from Hunton & Williams commented in Law 360 that 'businesses already using these technologies need to keep abreast of new legislation that might affect the legality of their practices' and that businesses should consider the implementation of the technologies and should consult rules and statutes before implementing biometric imaging.
