The Court of Appeal overruled a line of authority, finding, in Selvarajan v Wilmot & Others, that unreasonable delay in dealing with an appeal against dismissal did not make the dismissal automatically unfair. This was, the Court reasoned, because the statutory procedure had been completed. The procedure was completed when the appeal was dismissed. There were no steps left that the employer could take.
