Full text of the Court's decision

On November 16, 2010, the 10th District Court of Appeals upheld Ohio’s workplace smoking ban by reversing an earlier decision by the Franklin County Court of Common Pleas that threw out smoking law violations against Zeno’s Victorian Village, a bar in Columbus.

Zeno’s owners, Bartec, Inc., had originally argued that the bar should not be held responsible for the actions of its patrons. However, the Court of Appeals stated that it had found “overwhelming” evidence that the bar’s owners had repeatedly and intentionally ignored the smoking ban by allowing patrons to smoke in the bar.
