FCA is consulting on minor changes to its rules and guidance as a result of Mortgage Credit Directive (MCD) implementation. The changes relate to ensuring that mortgage contracts entered into by housing associations on or after 21 March 2016 will be outside the scope of FCA’s mortgages regime where such lending is outside the scope of the MCD, is a bridging loan, or involves a restricted public loan. Proposed changes will affect the Perimeter Guidance manual (PERG), Glossary of terms and the Mortgage and Home Finance: Conduct of Business sourcebook (MCOB) in the Handbook. FCA notes that housing associations with a back book of Consumer Credit Act loans predating 1 April 2015 should ensure they have applied for the correct consumer credit permissions.
