TIPO promulgated the amended Examination Guidelines for Chinese Herb-related invention patents and Pharmaceutical-related invention patents, effective from January 1, 2013.  The amended guidelines mainly include: in conformity with the absolute novelty principle of a substance, an invention pertaining to the new use (second use) of a known compound must be claimed in the format of a use claim or a Swiss-type claim, rather than in a claim having the subject matter of a (pharmaceutical) composition limited by the use thereof.
