Revised regulations giving greater protection to agency workers will come into effect on 1 October 2011. Workers who are not classed as employees but carry out more than 12 weeks continuous work will be entitled to some of the same rights enjoyed by employees. These will covers issues such as overtime, rest periods, holidays and access to training and facilities (eg, childcare). However, the directive does not include pension provisions or occupational sick pay. Contractors who use agency workers on a regular basis should pay close attention to these new regulations.
