From 10 October 2016, IP Australia will be changing many of its official fees for trade mark matters – some will increase and some will be removed altogether.

The main change to be aware of is that the official fees for all trade mark applications – including standard, series and Headstart applications – will increase. For example, for most standard trade mark applications, the official fees will increase from AUD$200 to AUD$330 per class. Therefore, if you are considering filing a new application at the moment, you may wish to do so before 10 October when the official application fees will increase. The current fees are set out here.

From 10 October, the registration fee of AUD$300 per class will be removed, and no registration fee will be payable. This change will only apply to trade marks applied for from 10 October 2016 onwards; registration fees will still be payable for applications which were filed before that date.

Other fee changes will affect trade mark oppositions and renewals. Maddocks professional fees for trade mark work will not change at this time.
