EPA signed a final rule May 16, 2011, delaying the effective dates for the “National Emission Standards for Hazardous Air Pollutants for Major Sources: Industrial, Commercial, and Institutional Boilers and Process Heaters” and “Standards of Performance for New Sources and Emission Guidelines for Existing Sources: Commercial and Industrial Solid Waste Incineration Units.” The rules, which were issued in February 2011, will be delayed indefinitely while EPA takes another round of comments from the public and reviews complaints from industries that use boilers to power and heat their operations. EPA is granting a stay of the effective date of the rules under the Administrative Procedure Act, which allows an agency to delay new rules as long as necessary “when justice so requires.”
