The Federal Government published on 28/06/2013, the Decree no. 8.033 regulating the Law no. 12.815 of June 5th, 2013 (New Ports Law) and other legal provisions governing the exploration of organized ports and port facilities.

The decree sets out that the Special Secretary of Ports (SEP) is incumbent upon exercising the authority the latter has been vested to by the government regarding concessions, leases and authorizations of exploitation, direct or indirect, of ports and port facilities, as well as the activities performed by the port operators.

ANTAQ´s and the Port Administration ´s authorities are also defined. The decree details the bidding processes rules for concession or lease of ports and port facilities located inside the areas of organized port and authorizations for exploitation of port facilities located outside the organized ports.

The decree creates the National Permanent Forum for the Port Worker ´s Qualification namely to discuss about matters related to training, qualification and professional certification of the port worker and free- lance worker.

The decree also creates within the scope of the National Employment System - SINE´ a specific database for free-lance port workers and other port workers, whose aim is to identify and organize the offer of skilled labor for the port segment.

The decree in its final provisions sets out that the applications for port facility authorization presented to ANTAQ until the date of publication of the decree may give rise to the immediate opening of a public notice in order to identify whether there are other parties interested in obtaining authorization for the same port facility.

The Decree no. 8.033 revoked the Degree no. 6.620 of October 29th, 2008 which dealt with the matter when the former Ports Law was still in effect.
