In November 2008, a new regulation was finalized that required all federal contractors and subcontractors to verify the immigration status of its employees through an internet-based authorization system operated by the Department of Homeland Security (DHS) and the Social Security Administration (SSA). The “E-Verify” regulation was originally slated to go into effect on January 15, 2009. However, prior to the original effective date, the implementation was postponed until February 20, 2009. With the installation of the Obama Administration, the new applicability date is expected to be extended to May 21, 2009, and solicitations that occur prior to May 21, 2009, would not result in a contract that would impose the obligations under the “E-Verify” regulation.
