The U.S. Department of Transportation’s (DOT’s) Surface Transportation Board (STB) has revised its rules on solid waste facilities along rail lines by authorizing federal permits that preempt state laws and regulations. The revisions clarify STB’s authority under the Clean Railroads Act of 2008 (Act) to issue “land-use exemption permits” that preempt state laws or rules related to the facilities’ siting. The Act gave states authority to regulate solid waste facilities along rail lines, except for the permits. STB requests comments by May 23, 2011.
