AFME considers contractual recognition of bail-in: AFME has published a note on the legal and practical issues arising from article 50 of the Bank Recovery and Resolution Directive. This article says that, to count towards the minimum requirement for "bail-in-able" own funds and liabilities, banks' liabilities that are governed by the law of a third country should include provisions ensuring that their bail-in will be effective.
